PIL seeks Tamil Nadu DGP guidelines on social media, political speech cases
A petitioner has moved the Madras High Court seeking directions to the state's police chief to frame guidelines for registering criminal cases related to social media posts and online political criticism. The plea draws on precedent set by the Telangana High Court, which issued similar guidelines last year.

A public interest litigation filed before the Madras High Court has urged the state's Director General of Police to establish comprehensive guidelines governing the registration of criminal cases against individuals for social media posts, political criticism, and online speech.
The petitioner argued that such guidelines are necessary to prevent arbitrary police action and ensure uniformity in the application of law across Tamil Nadu. The plea contends that the proliferation of cases registered against citizens for legitimate online expression has created uncertainty and chilled free speech in the state.
In support of the petition, the litigant pointed to a precedent established by the Telangana High Court, which framed a set of guidelines for police authorities in that state last year to regulate the registration and investigation of cases related to online speech and social media activity. The petitioner suggested that Tamil Nadu could adopt a similar framework to address concerns about police discretion in such matters.
The guidelines sought would aim to provide clarity on when criminal cases should be registered under relevant provisions of the Indian Penal Code and the Information Technology Act, particularly in cases involving political commentary, satire, and criticism published on digital platforms. Such standardized procedures could help reduce potential misuse of criminal law to suppress legitimate expression.
