The Reserve Bank of India has issued a clarification exempting individuals from new reporting requirements under the Foreign Exchange Management Act (FEMA), easing compliance concerns across the digital payments ecosystem.
The exemption specifically protects individuals receiving or making legitimate cross-border payments for personal or small-scale professional purposes from additional reporting obligations. This means that individuals engaged in routine international transactions—such as remittances, professional freelance work, or personal transfers—will not face heightened documentation burdens.
Small digital service providers and fintech platforms have welcomed the RBI's move, as it clarifies the regulatory landscape without imposing disproportionate compliance costs on low-value transactions. The clarification distinguishes between individual-level transactions and those conducted by businesses or commercial entities, which remain subject to existing FEMA regulations.
The RBI's announcement is expected to provide relief to India's growing digital payment sector, where many small operators and individuals conduct cross-border transactions regularly. By exempting legitimate personal and small-scale professional payments, the central bank has sought to balance regulatory oversight with practical business realities in the digital economy.
