Exporters participating in India's Duty Free Import Authorization (DFIA) scheme are facing unexpected demands from customs authorities to repay Remission of Duties and Taxes on Exported Products (RoDTEP) credits, creating confusion about the legitimacy of their incentive claims.
The dispute stems from a regulatory misalignment between customs interpretations and guidelines stipulated in the Foreign Trade Policy (FTP). Customs officials contend that certain RoDTEP credits should not have been granted to DFIA exporters, prompting recovery notices that contradict earlier approvals issued under FTP provisions.
Industry stakeholders argue that the discrepancy requires urgent retrospective clarification from policymakers to protect exporters who acted in good faith based on existing FTP guidelines. Without prompt intervention, legitimate export operations face financial disruption from unexpected liability claims months after transactions have been completed.
The situation highlights the need for greater coordination between the Ministry of Commerce and the Central Board of Indirect Taxes and Customs to ensure uniform interpretation of export incentive schemes. Trade bodies have called for an official directive clarifying the eligibility criteria for RoDTEP claims under DFIA to prevent further disputes and provide certainty to the export sector.
