MANILA — Former Senator Juan Ponce Revilla has mounted a legal challenge to the malversation charges he faces, contending that an examination of the prosecution's evidence warrants his acquittal. Revilla's argument was presented through a demurrer to evidence filed with the Sandiganbayan on Monday, where he contests the sufficiency of the case built by special prosecutors. The demurrer, comprising 24 pages, was attached to a motion for leave submitted to the anti-graft court.
A demurrer to evidence is a legal motion filed after the prosecution has presented its case, arguing that even if all allegations are proven true, they do not constitute the crime charged or that the evidence is legally insufficient to establish guilt beyond reasonable doubt.
The Sandiganbayan, which has jurisdiction over high-ranking government officials and public figures accused of crimes, will now evaluate Revilla's arguments against the prosecution's presentation. The court's ruling on the demurrer will determine whether the case against the former senator proceeds to the defense phase or if he is acquitted based on the insufficiency of evidence.
