Sand mining firm forfeits RM3.5mil over contract breach ruling

The High Court determined that Power KK Resources Sdn Bhd breached its contractual obligations by continuing sand extraction and sales operations from May 2020 onwards without honouring payment commitments to the principal contractor.

The forfeiture of the RM3.5 million in deposits represents a significant financial penalty for the mining firm's breach of contract. The court found that the company's continued extraction and commercial sale of sand materials during the period in question constituted a material violation of the agreement between the parties.

The ruling underscores the judiciary's position on enforcing contractual compliance within Malaysia's mining and natural resource extraction sector. Companies operating under such agreements are expected to maintain full compliance with payment obligations to their primary contractors throughout the duration of their operations.

This case serves as a reminder to resource extraction firms of the legal consequences of unilateral contract breaches and the financial liability they may face when failing to meet agreed-upon payment terms.
