The Securities and Exchange Board of India (SEBI) and the European Securities and Markets Authority (ESMA) have signed a memorandum of understanding aimed at deepening regulatory cooperation on clearing houses and central counterparties. The pact establishes a structured framework for the two regulators to exchange information and coordinate oversight activities relating to entities under their respective jurisdictions.
Central counterparties, commonly known as clearing houses, play a critical role in financial market infrastructure by acting as intermediaries in securities transactions and reducing counterparty risk. The MoU between SEBI and ESMA reflects growing recognition of the need for international coordination in supervising these systemically important institutions.
The agreement enables the Indian and European regulators to share relevant supervisory data and intelligence on clearing houses, enhancing their ability to identify and address potential risks. This collaborative approach is particularly significant given the cross-border nature of modern financial markets and the interconnectedness of clearing systems across different regions.
The cooperation framework also provides for consultations between SEBI and ESMA on regulatory matters related to central counterparties, supporting the development of consistent international standards. The accord underscores both regulators' commitment to maintaining financial stability and protecting market participants in their respective jurisdictions.
