SIT clears KSU activists in former Kerala health minister case

A Special Investigation Team (SIT) examining charges against Kerala Students Union (KSU) activists has determined that the evidence does not support prosecutions for rioting, wrongful restraint, and trespass in connection with a protest involving former Health Minister Veena George.

In its final report, the SIT found no basis for the charges, noting that the activists neither obstructed police personnel nor unlawfully detained the former minister. The investigation concluded that the black flag protest, a recognized form of peaceful political expression, cannot be classified as a criminal offence under existing legal provisions.

The findings represent a significant development in the case, as they suggest the initial charges were not substantiated by investigative evidence. The SIT's conclusion aligns with legal precedent recognizing peaceful protest as a fundamental right protected under the Indian Constitution.

The case had drawn attention from student organizations and civil liberties advocates who questioned the appropriateness of criminal charges against protesters exercising their democratic rights. The SIT report now provides official recognition of those concerns, potentially paving the way for withdrawal of charges against the KSU activists involved in the demonstration.
