Speaker Outlines Impeachment Process Against Chief Election Commissioner

The Speaker of the Lok Sabha has outlined the constitutional procedure that would be followed in the event of an impeachment motion against the Chief Election Commissioner (CEC), detailing each step from investigation through parliamentary approval.

According to the procedure, if an investigation committee submits a report concluding that the CEC has engaged in misconduct or demonstrated incompetence, the report and the impeachment motion would be tabled before the house where the motion is pending for consideration.

The Speaker explained that the misconduct or incompetence allegations would be considered proved only after both houses of Parliament approve the motion in accordance with the relevant provisions of the Constitution. The process draws on Article 124 of the Constitution, which establishes the impeachment framework for constitutional functionaries, with corresponding provisions adapted for the CEC.

The clarification comes as parliamentary procedures for removing senior constitutional officers remain a matter of public interest. The multi-stage process ensures that such serious actions against high-ranking officials receive thorough scrutiny and require substantial consensus before implementation, reflecting the constitutional safeguards built into India's impeachment mechanism.

The Speaker's statement provides clarity on the rarely-invoked constitutional procedure, which has seen limited application in India's parliamentary history.
