Supreme Court calls for uniform law to protect court-ordered deposits

The Supreme Court of India has highlighted a critical gap in the legal framework governing court-ordered deposits, which often run into several crores of rupees. The absence of uniform rules across different jurisdictions and court levels is creating administrative confusion and inconsistent treatment of these deposits, the bench observed.

According to the court's assessment, the asymmetrical handling of deposits—whether held as security, interim relief, or on other grounds—is contributing to delayed case disposals and prolonged litigation. Without standardized procedures, funds remain trapped in ad-hoc arrangements that lack adequate safeguards and transparency.

The court has called upon the legislature to frame comprehensive legislation that would establish clear, consistent protocols for the deposit, custody, and management of court-ordered sums. Such a law would ensure uniform application across all levels of the judiciary and protect these funds from mismanagement or loss.

The issue assumes particular significance given the substantial volumes of money held in courts at any given time. Legal experts and court administrators have long flagged the need for modernized deposit management systems that would streamline processes and reduce unnecessary case pendency linked to deposit-related complications.
