The Supreme Court has rejected attempts by Chetan and Nitin Sabharwal, sons of retired Chief Justice Y.K. Sabharwal, to challenge income tax reassessment proceedings against them. The dismissal of their four appeals clears the way for tax authorities to proceed with investigations into the financial transactions in question.
The reassessment notices pertain to two key matters: a share transaction dating back to 2007 and the purchase of a property located on Sikandar Road in Delhi. The tax department had issued fresh assessment notices requiring the brothers to account for these transactions and their associated valuations.
The brothers had moved the apex court seeking relief from the reassessment proceedings, arguing against the income tax authority's findings. However, the Supreme Court bench rejected all four appeals, effectively upholding the tax department's position and the validity of the reassessment notices.
With the court's dismissal, the income tax authorities can now proceed with their investigation and complete the reassessment process without further judicial impediment. The case had drawn significant attention given the prominence of the Sabharwal family, with Y.K. Sabharwal having served as Chief Justice of India from 2004 to 2005.
The matter remains part of ongoing scrutiny by tax authorities into the financial transactions of the former CJI's family members during the period covered by the reassessment notices.
