Supreme Court imposes safeguards against POCSO Act misuse in custody disputes

The Supreme Court has laid down mandatory safeguards to prevent misuse of the Protection of Children from Sexual Offences (POCSO) Act in cases where matrimonial disputes between parents could lead to false accusations.

In its directive, the apex court stipulated that police must adhere to specific procedural requirements before arresting parents or family members in POCSO cases where custody or matrimonial discord is a factor. The safeguards are designed to prevent the weaponisation of stringent child protection provisions during heated family disputes.

The court recognised that while the POCSO Act serves a critical protective function for children, its provisions have occasionally been misused in matrimonial and custody conflicts. The ruling emphasises the need for careful investigation and verification before law enforcement takes coercive action in such sensitive circumstances.

The Supreme Court's intervention reflects growing judicial concern about balancing the protection of children with preventing false accusations that can destroy families and clog the criminal justice system.
