The Supreme Court of India has issued notice to Birla Sun Life Insurance Company, seeking its response on a petition challenging the imposition of service tax on reinstatement charges levied by the company.
The insurance company has challenged an order passed by the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) that upheld the service tax demand on reinstatement charges, along with a penalty imposed by tax authorities. Birla Sun Life contends that the levy is incorrect and has approached the apex court for relief.
The Supreme Court has decided to tag the petition with another similar matter already pending before it, which involves comparable service tax issues in the insurance sector. This consolidation is expected to streamline proceedings and ensure consistency in judicial interpretation.
