Supreme Court Seeks Response on Election Commission Decision-Making Process

The Supreme Court on Wednesday sought responses from the Election Commission of India (ECI) and the Union government regarding the decision-making processes adopted by the poll panel's leadership.

A bench hearing the matter noted that decisions of the Election Commission must be made either on a unanimous basis or through majority voting. The court expressed the presumption that the poll panel has been following these procedural requirements in all its decisions.

The petition challenging certain decisions taken by the Commission-led panel was admitted for consideration. The court's intervention comes as questions have been raised about the procedural validity of some Election Commission determinations.

The notices served on the ECI and the Centre will require them to file detailed responses explaining the decision-making methodology employed by the poll panel in its recent actions. The court's observations suggest a judicial interest in ensuring that the Election Commission adheres to established protocols for collective decision-making among its commissioners.

The matter is now scheduled for further hearing after the responses are filed, with the Supreme Court likely to examine whether the poll panel's procedures align with constitutional and legal requirements governing its operations.
