Motor accident claims in India follow a structured legal framework that determines who can file claims, which parties bear financial responsibility, and how compensation is calculated. The process begins with establishing eligibility—claims can be filed by the vehicle owner, injured parties, or legal representatives of the deceased, depending on the circumstances of the accident.

Liability determination forms the cornerstone of the compensation process. Insurers can be directed to pay claims when the policyholder's vehicle caused injury or death to third parties. The insurer may subsequently recover amounts from the vehicle owner if negligence or policy violations are established. This mechanism protects innocent claimants while ensuring accountability for policy breaches.

When a death occurs due to a motor accident, the deceased's legal heirs can file compensation claims. The law recognizes four primary heads of compensation in fatal cases: funeral expenses, loss of earnings the deceased would have provided, loss of consortium and services, and non-pecuniary damages such as mental suffering and loss of expectation of life.
