US appeals court restores $3 million award in child cancer death case

A Georgia appeals court has reinstated a substantial portion of a jury's original award in a high-profile medical malpractice case involving the death of a three-year-old child undergoing cancer treatment. The court raised the judgment to $3 million, reversing a trial judge's earlier decision to reduce the jury's $37 million verdict to just $2 million.

The child had been diagnosed with stage-four Burkitt lymphoma and died from complications that arose during the course of treatment. The parents pursued legal action against the medical providers involved in their son's care, contending that negligence contributed to his death.

The appeals panel determined that under Georgia state law, the parents qualified as separate legal entities entitled to distinct compensation. This recognition of their individual status as parents proved crucial in the court's decision to significantly increase the award beyond the trial judge's reduction.

The case highlights ongoing disputes over damage caps and appropriate compensation levels in medical malpractice proceedings. While the final $3 million award remained substantially below the original jury verdict, the appeals court's decision represented a substantial victory for the family after the dramatic downsizing imposed by the trial judge.
