US Court Awards Widow Half of Late Husband's $2.33 Million Estate

A Kentucky appeals court has delivered a significant ruling on estate division, awarding a widow half of her late husband's $2.33 million in investment accounts despite the accounts naming his adult children as beneficiaries. William E. Perrine died without leaving a will in 2024, triggering the legal dispute over his substantial estate.

The court's decision upheld Nancy Perrine's marital claim to a portion of the investment accounts, establishing that her rights as a surviving spouse superseded the beneficiary designations on the financial accounts. Kentucky law provides surviving spouses with statutory rights to a portion of a deceased spouse's estate in the absence of a valid will.

The appeals court also ruled that Nancy Perrine was entitled to half of approximately $126,000 in gifts that her husband had given to his children and grandchildren in the months preceding his death. The court examined the timing and nature of these transfers in determining the widow's rightful share.

The case highlights the importance of estate planning and the legal protections afforded to surviving spouses under state inheritance laws. Without a will, Kentucky's intestacy laws determine how an estate is divided among family members, prioritizing the surviving spouse's interests alongside those of other heirs.
