US court blocks town's land seizure bid for affordable housing project

A federal court has invalidated the Town of Johnston's seizure of a 31-acre parcel, determining the municipality lacked legal authority to exercise eminent domain over the property. The ruling allows the Santoro family to move forward with their planned affordable housing project comprising 252 residential units on the land.

The town had sought to acquire the property through eminent domain, asserting it required the land for development of a municipal complex. However, the court found the township's actions violated procedural requirements and proper notification protocols mandated by law.

The judge's decision centered on Johnston's failure to adhere to established legal procedures for such land seizures, including inadequate public notification and notification to the property owners. These procedural lapses proved decisive in the court's rejection of the municipality's eminent domain claim.

The ruling represents a significant victory for private property rights and removes a major barrier to the affordable housing initiative. The Santoro family may now pursue their residential development plans without the threat of municipal seizure, potentially addressing housing scarcity in the region.
