A US appeals court in Ohio has ruled in favour of a woman seeking her share of proceeds from a property sale following her separation from her long-term partner. The couple had executed a formal agreement in 2021 stipulating how the sale proceeds would be divided should the property be sold.
Following their breakup, the man challenged the enforcement of the agreement, arguing that his former partner had not invested sufficient funds in home renovations to warrant an equal share. He claimed this entitled him to retain a larger portion of the sale proceeds.
The Ohio appeals court rejected his challenge and upheld the original agreement between the parties. The ruling compelled the man to pay his ex-partner $41,466.50 from the house sale, representing her agreed-upon share.
The decision underscores the enforceability of written agreements between unmarried couples regarding property rights and financial obligations, even after relationship dissolution. Legal experts note that such contractual arrangements provide clarity and protection for both parties in the event of separation.
