US court rules part-time doctor capable of full-time work in custody case

A physician in Indiana has lost her legal challenge against a financial assessment that valued her earning potential significantly higher than her reported income, even as she maintains reduced work hours to provide childcare for her newborn daughter.

The Indiana Court of Appeals upheld the lower court's determination that the doctor is capable of working full-time, calculating her weekly earning capacity at $8,811, compared to her actual reported weekly income of $6,677. The disparity reflects the court's view that the physician could increase her hours despite her current childcare responsibilities.

The appeals court's decision came as part of a custody and support matter involving the doctor and her former husband. In addition to the income assessment, the court upheld an order permitting the father three overnight stays per week with their daughter.

The ruling highlights ongoing legal tensions around work-life balance considerations in family law cases. While courts may recognize childcare as a legitimate responsibility, they often retain the authority to assess a parent's theoretical earning capacity based on their qualifications and profession, rather than solely on actual current earnings.

The case underscores broader questions about how family courts balance the recognition of parental care with financial obligations and income assessment standards, particularly in high-earning professions where earning capacity may exceed actual work output.
