US court upholds prenup despite language barrier claims in divorce case

The Kentucky Court of Appeals has upheld a prenuptial agreement in a divorce case, dismissing claims by a woman who argued she faced language barriers and undue pressure when signing the document. The woman, who had relocated from China to Kentucky on a fiancé visa, signed the agreement merely 11 days after arriving in the country.

The case highlighted a substantial financial imbalance between the former spouses. While the husband's assets exceeded $1 million, the woman's assets amounted to approximately $39,000. Despite this disparity, the appeals court determined that the prenuptial agreement remained valid and enforceable.

The woman's legal challenge centred on assertions that her limited command of English at the time of signing, combined with alleged pressure, compromised her ability to provide informed consent. However, the court found insufficient grounds to invalidate the agreement on these grounds.

The ruling reinforces established legal precedent regarding prenuptial agreements in the United States, where such contracts are generally enforceable when executed with basic procedural compliance. The decision underscores the importance of legal representation and language accessibility in matrimonial agreements, particularly in cases involving international marriages.
