US ends automatic work permit extensions for renewal applicants

The United States Citizenship and Immigration Services (USCIS) has discontinued an automatic 540-day work permit extension that previously allowed employment authorization document (EAD) holders to continue working while their renewal applications were pending. Under the previous system, workers could maintain employment authorization throughout the lengthy USCIS review process, even if their original permits expired before a decision was issued.

The policy change applies to renewal applications filed on or after October 30, 2025. Workers whose permits expire before USCIS approves their renewal requests may face employment gaps, as they will no longer automatically retain work authorization during the processing period. The duration of USCIS EAD processing varies significantly, with some cases taking considerably longer than others.

Immigrant worker advocates have raised concerns about the implications of this policy shift, particularly for sectors reliant on temporary workers. The change could create uncertainty for employers sponsoring foreign workers and may disrupt employment for individuals awaiting permit renewals during the transition period.

Workers affected by this change are advised to monitor their application status closely and consult with immigration attorneys regarding their specific circumstances. Employers sponsoring immigrant workers should review their human resources policies to account for potential employment authorization gaps during the renewal process.
