Vietnam's National Assembly strengthens administrative penalties framework

The revised Law on Handling of Administrative Violations, comprising six chapters and 128 articles, represents a significant strengthening of Vietnam's enforcement mechanisms. The proposed legislation would extend the statute of limitations for penalties to two or three years in certain sectors, giving authorities greater flexibility in pursuing violations.

Financial penalties would increase substantially under the new framework. Maximum fines for individuals would rise from 1 billion VND (approximately $38,000 USD) to 1.5 billion VND, while penalties for organizations would jump from 2 billion VND to 3 billion VND. The revision also establishes sector-specific maximum fine thresholds to ensure proportionate enforcement across different industries.

The National Assembly deputies have proposed these enforcement measures as part of ongoing efforts to strengthen Vietnam's administrative law system. The comprehensive overhaul aims to improve compliance with regulations while providing clearer guidelines for penalty determination across various administrative domains.

The proposed changes reflect lawmakers' commitment to modernizing Vietnam's administrative penalty framework to better address contemporary violations and ensure more effective enforcement of regulations governing public administration.
