Woman awarded $448,000 after contractor's river barrier fails catastrophically

Elizabeth Molbert pursued legal action against a contractor following extensive damage to her home caused by the failure of a $32,500 river barrier. The wooden bulkhead, designed to protect her property from water damage, gave way and resulted in costly structural repairs to her residence.

A jury initially determined that the contractor bore 75 percent responsibility for the bulkhead's failure. However, the appeals court subsequently reviewed the case and reached a more decisive conclusion, eliminating any attribution of fault to Molbert herself.

The higher court's decision resulted in increased compensation for Molbert, awarding her $448,431.34 in total damages. The judgment included adjustments to her mental anguish damages to reflect the full extent of her financial losses stemming from the contractor's failure to properly construct and maintain the river barrier.

The case underscores the importance of contractor accountability in infrastructure projects designed to protect residential properties from environmental hazards. The verdict reinforces homeowners' legal recourse when such protective structures fail due to contractor negligence or defective workmanship.
